ANDl Superior Court of Justice of Madrid has confirmed the second sentence that acquitted ex-footballer Xabi Alonso, current coach of the subsidiary team of the Real society, after being accused of defraud the Treasury almost two million euros during the 2010, 2011 and 2012 fiscal years.
The judicial journey of his case has been long: the Provincial Court of Madrid acquitted him, but he TSJ of Madrid ordered to repeat the trial; the Audience acquitted him again and, after appealing the Prosecutor’s office and the State Advocacy, on this occasion the court ratifies the acquittal.
Alonso, who started his career in the Real society and went through the Liverpool, the Real Madrid and the Bayern Munich, was a tax resident in Spain and paid personal income tax in 2010, 2011 and 2012, but did not declare the returns obtained from the exploitation of their image rights because it had yielded its exploitation to a company based in Madeira (Portugal).
In a sentence to which Efe has had access, The Supreme Court maintains that the facts charged may fit into the figure of fraud, but there is no simulation, because the taxable event recorded -the exploitation of image rights by assignment of its owner- actually took place and reality was not falsified.
Alonso, according to the Court, he acted “in the belief that this proceeding was in accordance with the law”.
This is how the Provincial Court, which pointed out that “if the transfer of the player’s rights to Kardzali (the Madeira company) was real and this entity actively intervened in its exploitation, the accusing claims decline “.
In addition, he noted, “It is not about opaque, hidden, falsified or excluded income by the taxpayer from the knowledge of the Tax Agency”.
